Terms and Conditions

Please read these Terms and Conditions carefully before using the All Island Tours website (the "Website") or booking any tours or services offered by All Island Tours ("we," "us," "our," or "Company"). By accessing our Website or making a booking, you ("you," "your," or "Customer") agree to be bound by these Terms and Conditions.

These Terms and Conditions, along with our Privacy Policy, constitute the entire agreement between you and All Island Tours regarding your use of our services and Website.

Our Services

All Island Tours acts as a tour operator, providing a range of travel services in Sri Lanka, including but not limited to:

  • Pre-designed tour packages
  • Customized tour itineraries
  • Accommodation bookings
  • Transportation services
  • Guided tours and excursions
  • Other travel-related services as described on our Website or in your booking confirmation.

We undertake to provide our services with reasonable skill and care.

Eligibility to Use Our Services

By making a booking with All Island Tours, you warrant that:

  • You are at least 18 years of age and possess the legal authority to create a binding legal obligation.
  • You will use our Website and services in accordance with these Terms and Conditions and all applicable laws and regulations of Sri Lanka.
  • All information supplied by you is true, accurate, current, and complete.
  • If you are making a booking on behalf of others, you are authorized to act on their behalf, and you will inform them of these Terms and Conditions. You will be responsible for making all payments and for keeping other members of your party informed of all booking details.

Booking Process and Confirmation

  • Enquiry and Quotation: You can make an enquiry through our Website, email, or phone. We will provide you with a detailed tour proposal and quotation based on your requirements.
  • Booking Confirmation: To confirm a booking, you must typically provide written confirmation (e.g., via email) and pay the required deposit as specified in your quotation or invoice.
  • Binding Contract: A binding contract between you and All Island Tours comes into existence once we have received your confirmation and the required deposit (or full payment if applicable) and we issue you a booking confirmation invoice and/or travel voucher.
  • Accuracy of Details: Upon receiving your booking confirmation, please check all details carefully (e.g., names, dates, itinerary). Any inaccuracies must be reported to us immediately. Changes may not be possible later, or may incur additional charges.

Pricing and Payment

  • Prices: All prices for tours and services will be quoted in United States Dollars (USD) or Sri Lankan Rupees (LKR) as specified. Prices are typically per person unless stated otherwise. Prices are subject to change without prior notice until a booking is confirmed and the required payment is made.
  • Inclusions and Exclusions: The price quoted will clearly state what is included (e.g., accommodation, specified meals, transport, guide fees, entrance fees to specified sites) and what is excluded (e.g., international flights, visa fees, travel insurance, personal expenses, optional activities, tips).
  • Deposit: A non-refundable deposit is generally required to secure your booking. The deposit amount and due date will be communicated to you at the time of booking (typically 30% to 50% of the total tour cost, but this may vary).
  • Final Payment: The balance payment for your tour is typically due 30 to 45 days prior to the commencement of your tour, or as specified on your invoice. For bookings made within this period, full payment may be required at the time of booking.
  • Payment Methods: Payments can be made via bank transfer, secure online payment gateway (if available), or other methods as advised by us. Any bank charges or credit card processing fees associated with the payment must be borne by you.
  • Failure to Pay: If we do not receive the deposit or final payment by the due date, we reserve the right to treat your booking as cancelled by you, and cancellation charges as set out in Section 5 will apply.
  • Price Variations: We reserve the right to vary prices after confirmation only in the event of significant changes in government taxes, fuel prices, or other supplier costs beyond our control. You will be notified of any such increase and will have the option to pay the additional amount or cancel your booking (subject to applicable cancellation fees if the increase is minor, or with a fuller refund option if the increase is substantial, e.g., more than 8-10% of the tour price).

Cancellations and Amendments

Cancellation by You:

  • All cancellation requests must be made in writing (e.g., via email) and will be effective from the date we receive the written notification.
  • The following cancellation charges will generally apply, but specific cancellation terms may be provided in your booking confirmation, especially for tailor-made tours or during peak seasons:
    • More than 45 days prior to arrival: Loss of deposit (e.g., 30% of the total tour cost).
    • Between 30 and 44 days prior to arrival: 50% - 60% of the total tour cost.
    • Between 15 and 29 days prior to arrival: 75% of the total tour cost.
    • 14 days or less prior to arrival, or no-show: 100% of the total tour cost.
  • No refunds will be given for unused services, early departures, or no-shows once the tour has commenced.
  • We strongly recommend that you purchase comprehensive travel insurance that includes coverage for cancellation.

Amendment by You:

  • If you wish to make any changes to your confirmed booking, you must notify us in writing as soon as possible.
  • We will try our best to accommodate your requested changes, but they are subject to availability and may incur additional costs, including administrative fees and charges from suppliers.
  • Significant changes requested close to the departure date may be treated as a cancellation and re-booking, and cancellation charges may apply.

Cancellation by Us:

  • We reserve the right to cancel your booking in rare circumstances, such as due to force majeure events (see Section 10), or if the minimum number of participants required for a group tour is not met.
  • In such an event, we will notify you as soon as possible and offer you the choice of:
    • Accepting an alternative tour of comparable quality, if available (with a refund or additional payment if there is a price difference).
    • Receiving a full refund of all monies paid to us.
  • We will not be liable for any incidental expenses you may have incurred as a result of your booking, such as visa fees, non-refundable flights, or vaccinations.

Changes to Itinerary by Us:

  • While we endeavor to operate all tours as advertised, we reserve the right to modify the itinerary or services if necessary.

Your Responsibilities

  • Travel Documents: You are responsible for ensuring that you have valid passports (typically with at least 6 months validity beyond your intended stay), visas, and any other required travel documents for entry into Sri Lanka and for any transit countries. We can provide general advice but are not responsible for any issues arising from incorrect or incomplete documentation.
  • Health and Fitness: You are responsible for ensuring that you are medically and physically fit to undertake the chosen tour and participate in planned activities. You should consult your doctor for advice on vaccinations, medical precautions, and overall fitness. Please inform us at the time of booking of any pre-existing medical conditions, disabilities, or dietary requirements that may affect your tour. While we will try to accommodate special requests, we cannot guarantee them and are not liable if they cannot be met.
  • Travel Insurance: It is a condition of booking with All Island Tours that you have adequate and valid travel insurance. Your insurance should cover, at a minimum, medical expenses, emergency repatriation, cancellation or curtailment of your tour, personal accident, and loss of baggage and personal effects. You may be required to provide proof of your travel insurance.
  • Compliance with Laws and Conduct: You agree to comply with all local laws, regulations, and customs of Sri Lanka. You must also behave in a manner that does not cause danger, distress, or annoyance to other tour participants, our staff, or any third party, and does not damage property. If, in our reasonable opinion or the opinion of our suppliers (e.g., hotel manager, guide), your behavior is causing or is likely to cause such issues, we reserve the right to terminate your tour arrangements immediately without any liability for refunds or further costs incurred by you.
  • Punctuality: You are responsible for being punctual for all departures, excursions, and activities as per the itinerary. We are not liable for any loss or expense incurred due to your late arrival.
  • Damage to Property: You will be responsible for any damage or loss caused by you or any member of your party to property or facilities used during the tour. Payment for such damage or loss must be made directly to the property owner or service provider concerned.

Our Liability

  • All Island Tours acts as an agent for third-party service providers, such as hotels, transport companies, airlines, and activity providers. While we select our suppliers with care, we do not own, operate, or control these third-party services. Therefore, we are not liable for any death, personal injury, illness, damage, loss, accident, delay, or any other irregularity arising from any act or omission of any such third-party supplier or their employees or agents, unless caused directly by our own negligence.
  • Our liability to you for any loss or damage which you may suffer is limited to the total price of your booking with us, except in cases of death or personal injury caused by our proven negligence.
  • We shall not be liable for any indirect or consequential losses, loss of enjoyment, or loss of profit.
  • We are not responsible for any services that do not form part of our contract with you, such as any excursions or activities you book independently, or any international flights you arrange separately.
  • Information provided on our Website is given in good faith and updated regularly, but we cannot guarantee its complete accuracy at all times. We are not liable for any errors or omissions on the Website, provided they are not due to our negligence and are corrected once brought to our attention.

Complaints and Dispute Resolution

  • If you have any complaint about any aspect of your tour arrangements, you must inform our local representative or tour guide immediately, or contact our office as soon as possible. This will allow us the opportunity to investigate and attempt to resolve the issue on the spot.
  • If the matter cannot be resolved locally, you must submit your complaint in writing to us within 28 days of the completion of your tour, providing all relevant details.
  • Failure to follow this procedure may affect our ability to investigate your complaint and may impact your rights under this contract.
  • These Terms and Conditions and any contract to which they apply are governed in all respects by the laws of Sri Lanka. Any dispute, claim, or other matter which arises between us will be subject to the exclusive jurisdiction of the courts of Sri Lanka.

Travel Advisories and Safety

  • You are responsible for making yourself aware of any travel advisories issued by your home country's government and the government of Sri Lanka regarding travel to Sri Lanka.
  • While we prioritize your safety and well-being, travel inherently involves risks. We will provide guidance and take reasonable precautions, but you acknowledge and accept these risks.

Force Majeure

  • We shall not be liable for any failure to perform, or delay in performance of, any of our obligations under this contract if such failure or delay is caused by a Force Majeure Event. A Force Majeure Event means any act or event beyond our reasonable control, including but not limited to acts of God, war or threat of war, riot, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire, epidemics, pandemics, government travel restrictions or advisories, or unavoidable technical problems with transport.
  • If a Force Majeure Event occurs, we will notify you as soon as reasonably possible. Our obligations under the contract will be suspended, and the time for performance of our obligations will be extended for the duration of the Force Majeure Event. We will endeavor to provide alternative arrangements or offer a refund for unutilized services, subject to the policies of our suppliers and any unrecoverable costs.

Special Requests

  • Any special requests (e.g., dietary requirements, room location, accessibility needs) must be advised to us at the time of booking.
  • While we will endeavor to pass any reasonable requests on to the relevant supplier, we cannot guarantee that such requests will be met.
  • Failure to meet any special request will not be a breach of contract on our part unless the request has been specifically confirmed by us in writing as a guaranteed part of the booking.

Intellectual Property

  • All content on our Website, including text, graphics, logos, images, and software, is the property of All Island Tours or our content suppliers and is protected by Sri Lankan and international copyright and intellectual property laws.
  • You may not reproduce, modify, distribute, or republish any content from this Website without our prior written consent.

Privacy Policy

  • We are committed to protecting your privacy. Our Privacy Policy, which is available on our Website, explains how we collect, use, and protect your personal information.
  • By making a booking with us, you consent to our use of your information in accordance with our Privacy Policy.

Amendments to Terms and Conditions

  • We reserve the right to amend these Terms and Conditions at any time without prior notice.
  • The Terms and Conditions that apply to your booking will be those in effect on the date your booking is confirmed.
  • We recommend you review the current Terms and Conditions on our Website before making a booking.

Severability

  • If any provision or part-provision of these Terms and Conditions is or becomes invalid, illegal, or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable.
  • If such modification is not possible, the relevant provision or part-provision shall be deemed deleted.
  • Any modification to or deletion of a provision or part-provision under this clause shall not affect the validity and enforceability of the rest of these Terms and Conditions.
